Transvaginal Mesh Lawsuits
Women who suffered serious injuries following implantation of pelvic mesh may be eligible to file a transvaginal mesh lawsuit seeking compensation or their medical bills, lost wages, pain and suffering and other damages. The vaginal mesh lawyers at Bernstein Liebhard LLP are actively filing claims in four vaginal mesh litigations underway in the U.S. District Court, Southern District of West Virginia, involving pelvic mesh devices manufactured by American Medical Systems, Inc., Boston Scientific Corp., C.R. Bard, Inc. and Johnson & Johnson’s Ethicon, Inc. subsidiary. Bernstein Liebhard LLP partner, Jeffrey Grand, is serving on the Plaintiffs’ Steering Committees in all of these federal litigations. The Firm is also involved in two consolidated proceedings underway in New Jersey Superior Court, Atlantic County that involve products manufactured by Ethicon and C.R. Bard. Mr. Grand is serving as Co-Liaison Counsel in both of these litigations.
Recoveries in vaginal mesh lawsuits can be significant. In February 2013, the Plaintiff in the first Ethicon pelvic mesh lawsuit to go to trial in the New Jersey litigation was awarded $3.5 million in compensatory damages. The previous summer, a trial in California state court involving a C.R. Bard product ended with a $5.5 million jury award for the victim and her husband.

Doing so would make the products ineligible for 510(k) approvals.
Injuries Resulting from Transvaginal Mesh
In 2008, the FDA issued a safety alert concerning serious complications associated with transvaginal mesh devices. Then in 2011, the agency warned that there had been a five-fold increase in reports of serious complications associated with the use of vaginal mesh. The FDA also modified its previous position on the frequency of such complications, stating in the alert that vaginal mesh injuries associated with pelvic organ prolapse repair were not rare. According to the agency, injuries resulting from vaginal mesh may include:
- Erosion through vaginal wall
- Infection
- Pain
- Urinary problems
- Recurrence of prolapse and/or incontinence.
- Bowel, bladder, and blood vessel perforation
